Obiettivi formativi
L'insegnamento si propone di fornire agli studenti e alle studentesse una essenziale preparazione nelle discipline giuridiche sportive con una conoscenza, non solo teorica, ma anche pratica delle problematiche concrete che possono manifestarsi nell’esercizio delle funzioni professionali sportive.
Gli argomenti trattati riguardano la struttura giuridica dell’ordinamento sportivo e i diversi profili di responsabilità - disciplinare, civile e penale - che possono conseguire alle attività professionali sportive. Sono inoltre trattate materie di interesse rilevante nell’ambito sportivo (per esempio, doping, ambush marketing, ecc.) .
La consapevolezza dei temi giuridici trattati costituisce un elemento imprescindibile per il corretto esercizio delle differenti applicazioni ed interventi delle professioni delle Scienze Motorie e Sportive.
Questa conoscenza deve integrarsi con gli altri ambiti di studio per formare il professionista delle Attività Motorie e Sportive, che opererà nelle strutture pubbliche e private, nelle organizzazioni sportive e dell’associazionismo ricreativo e sociale.
The course aims to provide students with a fair preparation in Sports law disciplines with a theoretical and practical knowledge of the various problems which may arise in the exercise of professional sports functions.
The topics concern the juridical structure of the sports system and the different profiles of responsibility - disciplinary, civil and criminal - which can be achieved in professional sports activities. In addition, issues of significant interest in the sports field are dealt with (for example, doping, ambush marketing, etc.)
The awareness of the juridical themes constitutes an essential element for the correct exercise of the different applications of the sports sciences professions.
This knowledge must be integrated with the other items of study to train the professional Sports Activities, which will operate in public and private structures, in sports organizations and in recreational and social associations.

CONOSCENZA E CAPACITÀ DI COMPRENSIONE
Al termine dell'erogazione dell'insegnamento si disporrà di una visione complessiva della disciplina giuridica in ambito sportivo - sia nei suoi profili privatistici che in quelli pubblicistici - con una conoscenza, non solo teorica, ma anche pratica delle problematiche concrete relative alla materia.
Si acquisirà conoscenza del quadro giuridico di riferimento dell'attività sportiva e delle responsabilità, sul piano disciplinare, civile e penale, conseguenti all'esercizio dell'attività sportiva.
La valutazione è il risultato del confronto tra insegnante e studentesse/i durante le lezioni, delle esercitazioni e dell'esame scritto al termine dell'insegnamento.
CAPACITÀ DI APPLICARE CONOSCENZA E COMPRENSIONE
Al termine dell'erogazione dell'insegnamento, gli/le studenti/esse saranno in grado di applicare le conoscenze giuridiche acquisite all'interno della loro attività professionale.
La verifica delle abilità e delle conoscenze acquisite sarà ottenuta dal superamento dell’esame scritto al termine dell'insegnamento. Per agevolare la preparazione per l'esame verranno svolte esercitazioni con autovalutazione, commentate in aula, durante l'erogazione dell'insegnamento.
AUTONOMIA DI GIUDIZIO
Le/gli studentesse/i dovranno imparare a muoversi all'interno delle norme deontologiche, etiche e giuridiche, che regolano il lavoro e le attività sportive. L'acquisizione di tale autonomia di giudizio sarà favorita dall’esame di sentenze aventi ad oggetto casi sportivi.
ABILITÀ COMUNICATIVE
Al termine dell'erogazione dell'insegnamento si saprà riconoscere i profili giuridici che conseguono alle varie attività professionali in modo da operare correttamente e da interagire efficacemente con le altre figure professionali che operano negli stessi settori.
CAPACITÀ DI APPRENDIMENTO
Al termine dell'insegnamento si acquisirà conoscenza degli aspetti giuridici fondamentali delle scienze motorie e sportive, sia in funzione di un eventuale inserimento diretto nel mondo del lavoro sia nella prospettiva del proseguimento degli studi nelle lauree magistrali.
L'acquisizione di tali competenze si unisce alla capacità di individuare in modo appropriato le leggi e i regolamenti sportivi da applicare nell'esercizio delle professioni sportive.
L’esame scritto è finalizzato a valutare le competenze acquisite.

KNOWLEDGE AND UNDERSTANDING
At the end of the course, the student will have to have a complete vision of the sports legal disciplines with a knowledge, not only theoretical, but also practical of the concrete problems related to the subject.
Students will learn the laws that regulate sports activities and the consequent responsibilities on the disciplinary, civil and penal level.
The evaluation is carried out with the comparison between teacher and students during the lessons and with the written exam at the end of the course.
APPLYING KNOWLEDGE AND UNDERSTANDING
At the end of the course, students will be able to apply legal knowledge within their professional activity.
The skills and knowledge acquired will be verified by passing the written exam at the end of the course.
INDEPENDENT JUDGEMENT
The student will have to learn to move within the juridical, deontological and ethical rules that regulate works and sports activities. The acquisition of this independence of judgment will be favored by the examination of judgments concerning sports cases.
COMMUNICATION SKILLS
At the end of the course the student will be able to distinguish the legal risks that follow from the various professional activities in order to operate correctly and to interact effectively with the other professionals figures who work in the same sectors.
LEARNING SKILLS
The student must acquire the knowledge of the fundamental juridical aspects of the sports sciences, in function of a possible direct insertion in the world of the work and in the perspective of the continuation of the studies in the magistral degrees.
The acquisition of these skills is associated with the ability to identify sports laws and rules to be applied in the exercise of sports professions.
The written exam will aim the evaluation of the acquired skills.

Modalità di insegnamento
Le lezioni dell'insegnamento hanno una durata complessiva di 40 ore. Salvo ulteriori restrizioni ingenerate dall'andamento pandemico, che verranno prontamente comunicate, la modalità di somministrazione del corso prevede lezioni frontali in presenza. Il materiale didattico verrà reso disponibile tramite la piattaforma Moodle attraverso la pagina E-Learning. Le istruzioni per l'utilizzo della piattaforma sono disponibili a questo link.
The lessons have a total duration of 40 hours. Unless further restrictions are imposed by the pandemic trend, which will be promptly communicated, the method of administration of the course includes lectures in presence. The teaching material will be made available through the Moodle platform through the e-learning page. The instructions for using the platform are available at this link.

Modalità di verifica dell'apprendimento
L’esame si svolgerà in presenza, in forma scritta.
Modalità esame scritto in presenza:
il compito d’esame si compone di trentadue domande a risposta chiusa. La durata dell’esame è di 70 minuti.
Le domande presentano tre risposte alternative di cui una sola è quella corretta.
Ogni risposta esatta equivale ad un punto. Per superare l’esame sono necessari almeno diciotto punti e la valutazione si quantifica in trentesimi. Le risposte errate non comportano penalità.
La risposta corretta a tutte le domande determinerà la valutazione di trenta e lode.
Gli studenti appartenenti a specifiche categorie (condizioni di fragilità da COVID-19) saranno autorizzati a partecipare agli esami scritti on-line (piattaforma webex).
The exam will be held exclusively in a written form.
The practice test consists of thirty multiple-choice questions (with three possible answers, of whom just one is true). It lasts seventy minutes.
Each multiple-choice question correctly answered will be evaluated with one point. In order to pass the test candidates must attain at least eighteen points.
The correct answer to all the questions will have a score of thirty points cum laude.
Students belonging to specific categories (conditions of fragility from COVID-19) will be allowed to participate in the written exams online (webex platform).
